BOOKING TERMS AND CONDITIONS

TO MAKE A BOOKING

Either download a booking form or contact us by email including your name and address, and we will send you a booking form through the post.
To confirm your booking an initial deposit of £200 pound is required. The outstanding balance must be paid at least six weeks prior to your departure in order to reconfirm your place.
IMPORTANT! please read the following information before completing our Booking Form.

TERMS AND CONDITIONS

On booking a tour with us, you enter into a contract with Mountain Bike Kerala. The company's registered office is at 11 Spenwood Road, Littleborough, Lancashire, OL15 8PF, UK.

1. Bookings. On receipt of your deposit and completed booking form, we will invoice you for the outstanding balance of your holiday cost. It is at this point that a valid contract between us is created. The outstanding balance must be paid at least six weeks prior to your departure in order to reconfirm your place. Should this final payment fail to reach us by the date specified on your invoice, we reserve the right to cancel your booking without refund.

2. Flights. We reserve the right to amend tour dates as a result of any airline schedule changes.

3. Cancellation by You On receipt of written notice of your cancellation you will be charged the following part of your tour cost), cancellation fee:

If you want to change your booking in any way, we will do our best to assist, although we cannot guarantee that it will be possible. Changes within 6 weeks of departure may incur cancellation charges on the scale shown in the above table.

3. Cancellation by Us. Mountain Bike Kerala tries to avoid making any changes to your holiday arrangements. However, we will only cancel your tour if:
a) it is forced to do so by as a result of unusual or unforeseen circumstances, such as war, unrest, terrorist activity, industrial disputes, natural or nuclear disaster, fire or adverse weather conditions, level of water in rivers or other similar events beyond our control.
b) it is forced to do so as a result of flight cancellations
c) the minimum number of bookings (4 persons) is not reached within 6 weeks. Before departure Mountain Bike Kerala reserves the right to cancel the tour and/or make significant modifications to the tour when it is absolutely necessary.

4. Cancellation by the Company. If Mountain Bike Kerala cancels your tour, you will be refunded all monies received in respect of the cost of the tour booking. We will not be liable for any other additional expenses which that you have incurred as a result of your booking.

5. Tour Changes Mountain Bike Kerala tries to avoid making any changes to your holiday arrangements. However, this type of adventure holiday could be subject to unforeseen changes in itinerary and it is a fundamental condition of your booking that you accept this.

6. Tour Leaders You must abide by the authority of your tour leaders. If they believe that your behaviour presents any risk to the safety of the group you may be asked to leave the group. You will not be entitled to any refund.

7. Complaints If you have a complaint about your tour you should communicate it to the leader immediately so that remedial action can be taken if possible. In any event you must notify the Company of any complaint, in writing, within 14 days of the tour’s completion.

8. Insurance It is a condition of joining one of our tours that you must be insured against medical and personal accident risk. Before coming on a tour you must take out have adequate insurance cover.

9. Mountain Bike Kerala Responsibilities. We accept no responsibility for any damage or loss arising from a failure to carry out the contract, or in the process of carrying out the contract, as a result of:
a) Inappropriate actions by you
b) unusual and unforeseen circumstances beyond the control of Mountain Bike Kerala
c) any event which the even with all due care and attention, could not have been foreseen or forestall or
d) the theft of or damage to bicycles or other equipment or injury to the Client which occur as result of cycling on or off a road, or while in transit in any vehicle, or at any other time during the holiday.
Where Mountain Bike Kerala is found to be liable for any damages, howsoever arising, these damages shall be limited to the price paid for the tour.

10. Provision of Information Any information provided by us is done so in good faith but without any liability on the part of Mountain Bike Kerala. You remain responsible for finding out establishing relevant information about your travel and/or requirements and any information necessary, such as vaccinations, visa requirements, baggage allowances, etc.

11. Cycle Hire a) You acknowledge that the cycle hired to you is in good condition and you undertake to return the cycle and any accessories in the same condition, or to make a payment sufficient to return the cycle to that the original condition. b) We shall not be liable for any damage or loss arising from your use of the equipment. Members of the tour shall indemnify Mountain Bike Kerala against any claim howsoever arising as a result of the Client’s use of the cycle during the period of hire. c) All monies due in relation to the hire of cycles will be added to the tour cost and will be payable at the same time as the remainder of the balance is required, in accordance with the booking conditions.

YOUR FINANCIAL PROTECTION

All monies paid by you under this contract are held in a Trust Account, controlled by a trustee acting on your behalf. These monies are not released to Mountain Bike Kerala until your holiday has been completed or, in the event of a cancellation, the contract has been completed in accordance with the booking conditions. This fully complies with UK law, as defined in The Package Travel, Package Holidays and Package Tour Regulations 1992, and is for the protection of you the consumer.

LIMITATION OF LIABILITY

The Company will do its utmost to make sure that your tour and all trip arrangements are satisfactory. Where any part of the trip booked with Mountain Bike Kerala is not supplied as described and is not of a reasonable standard, Mountain Bike Kerala will accept liability and will pay you reasonable compensation. Any claim for compensation will be restricted to a maximum compensation payment of 1.5 times the cost of the trip, and is subject to clause 16ii) below. You must take account of the reality of travel in India, that services and conditions cannot be expected to be of the same standard as in the UK, and the term ‘reasonable standard’ must be interpreted accordingly.
ii) The Company will not pay compensation in the following circumstances:- a) where the failures which occur in the performance of the contract are attributable to you; or
b) such failures are attributable to a third party unconnected with the provision of the services contracted for, and are unforeseeable or unavoidable; or
c) such failures are due to unusual or unforeseen circumstances or events beyond the control of Mountain Bike Kerala, its agents or suppliers, the consequences of which could not have been avoided even if all due care had been exercised.
